Auto Accidents and SSDI Eligibility?
/Many times our clients have sustained catastrophic injuries in auto accidents, whereby they are disabled from substantial gainful employment for a significant period of time or even for life. In those instances, where the client will be disabled for more than one year, he/she is usually eligible for Social Security Disability benefits. It is important for the client to discuss those benefits with hisauto insurance clip art or her lawyer in addition to the potential automobile insurance recovery. If the client qualifies for Social Security benefits, there usually is a retroactive check paid for approximately 12 months of arrearage benefits paid in one lump sum. Additionally, after an individual is disabled for more than one year, he/she would usually qualify for Medicare health insurance benefits. That is very important since the injured individual may have lost his or her job, lost his or her health insurance benefits and does not have resources available to obtain the medical treatment necessary to treat the injuries caused by the accident. After all, the automobile insurance company rarely advances funds for medical care, and relies on a final settlement or verdict in court to compensate for all past and future medical care.
The moral of the story is that when sustaining serious injuries as result of the fault of another, you may be entitled to not only recover from an insurance company for the individual who was at fault, but also be eligible to recover your own Social Security Disability benefits based on your own employment history. In addition to Social Security disability benefits, you may also be eligible for Medicare benefits so that you could receive necessary health benefits.
