Did you or a loved one become infected with Hepatitis recently?

HEPATITIS INFECTION FROM HOSPITAL STAY? IS THIS MEDICAL MALPRACTICE?

News sources have recently reported numerous individuals in southern New Hampshire acquiring the potentially lethal hepatitis C virus at an Exeter Hospital. There are numerous types of hepatitis C, and State health officials are able to actually trace the cause of the outbreak.

Every hospital must have an appropriate infection control plan in effect. If there is a breakdown in the infectious control program or if the program itself does not meet sufficient quality standards, the hospital and/or its agents may well be liable for providing an insufficient standard of care to patients.

Recently, attorneys hired by individuals who contracted hepatitis C have reported an intent to file a class action lawsuit. Please know that if you or your loved ones have contracted hepatitis C, they have no obligation to participate in a class action lawsuit. They could always “opt out” of the class action lawsuit and pursue their own individual claims.

In our opinion, individuals who opt out of such claims generally fair better at the time of settlement if the independent claim could be handled in a cost-effective fashion. It is always a good idea to speak with a competent law firm regarding any legal claims or concerns that you may have.

At Normand & Associates, we are always glad to speak with you at no charge.
