A man in Plaistow NH suspected of shoplifting while driving a stolen minivan was fleeing police when he struck a pedestrian and another vehicle. The individual then crashed the stolen vehicle into a tree, killing himself.

What insurance is available to help the injured, innocent people?

In most instances the insurance for the minivan would not cover liability caused by an unauthorized driver such as the person who stole the minivan. The pedestrian who sustained serious injuries DOES HAVE INSURANCE available through either his or her own automobile uninsured motorist policy or an automobile policy for any relative who lives with him or her. In other words, your own automobile policies provide extended coverage for ourselves when we are hurt by another, even if you are not in your vehicle at the time! Sometimes your own insurance company does not advise you about extended coverage, and you should consult with someone knowledgeable in the area to understand your rights.

Final Analysis:

  1. In the Plaistow case, the bystander in the vehicle who may have been hurt would look to his or her own automobile policy for uninsured motorist coverage to pay for injuries.
  2. The pedestrian who was hurt would look towards his or her own automobile policy to pay for their injuries.
  3. If the pedestrian had no automobile coverage themselves, the policy for any relative who lives with them would usually provide uninsured motorist coverage for them as well.
