/Facts: The claimant was 54 years old. He was a 20 year veteran of the US Army where he worked as a barber. He left the army in 2006 and began working in a barber shop as a civilian. Throughout the years he had to work less and less as a result of several injuries. Claimant suffered from sleep apnea, chromes disease, digenetive joint disease and bilateral planter fasciitis. The claimant was denied benefits by the Social Security Administration on August 13, 2010 as they found that the condition was not severe enough to prevent him from substantial gainful activity. He retained us to represent him in the appeal. We collected additional medical records and had providers fill out additional information regarding his impairments, we submitted an On the Record Request asking that benefits be awarded without the need for a hearing.
Case Result: The On the Record was approved and he was awarded retroactive benefits in the amount of $22,600 and monthly benefits of $1500.
Points of Interest: Claimant continued to work part-time during his period of disability as he continued to work 10 hours a week at a barber shop. However, we successfully argued that even though he was working part time he had not engaged in substantial gainful activity and could not work anymore then 10 hours as a result of his condition.
